& Mr. Thomas Kirkpatrick Merch[an]t. in Kirkcudbright a[ctin]g DeputeTo
Exec[uto]rs hereof conjointly & severally seperately
Constitute greeting It is my will & I charge you tharein contains[?] this my Edict
see you & also and in his majesties name and authority & made lawfully Summond warn
And charge All & Sundry the Execs. Testamentary Spouse Bairns if any be and
Intromettors which the Goods & Gear of the Decease Edward McCulloch of Ardwall
and all others having or pretending to have interest in the said Matter by open
Proclamation at the marcat Cross of Kirkcudbright head brought of this said Commissariot
& Parish[?] Kirk of Anwoth and other Places Need Such to Compear before me or
my said depute when the Tolbooth of Kirkcudbright upon the Third Day of
December next peremplarly in this hour of cause to answer at the instance[?] of
Elizabeth and Jamie McCullochs Daughter of the said Defunct that is to say
to hear and see the said Elizabeth & Jamie McCullochs Decerned admitted and
Given in Executor Dative qua Nearest in kin to the said Edward McCulloch
their father and in and to the Goods & Gear Debts Sums of money or others what
soever which justly pertained belong and were adebted renting and owing to
to the said Defunct the time of his Deceased which was in the month of September
last and not contained in that Inventory of his prior or af[oresai]d[?] Testament if he any
made or set purpose[?] omitted and left forth therof and also not in small to the
other awailis[?] & process of that same or Else to akndge. one reasonable cause in
the Contrary which Cause whichon as Expenses according to Justice that which to do
given at Kircudbright the Nineteenth day of November 1756 year
by David Tessans[?]

Laurced[?] prior for the reason of the Edict produced the same with the Executors on
the Back therof which being called & none conpearing to object the Commissary
Decerned Conform to the Edict & Conelunon therof and ordains the Execturs to give
down & in juratory[?] find Caution & Conform in Common form of ordains[?] Estates

Upon the Nineteenth day of November one thousand
& one hundred and fifty six years I James Fouler
Commissary Officer part[icular] at Command of the within
written Edict to the marcat Cross of Kircudbright being
head Brugh of the Commissariot of Kirkcudbright and
thereat being a mercat day between the hour of Eleven
and Twelve at midday after Crying three sober oyyess
I approach read and Proclaimed that said within Edict
and by virtue thereof in name and authority within
mentioned lawfully summoned warned & charged all
& sundry the Edicts Testamentary Spouse Bairns if any be
and information which the goods & gear of the Decease
Edward McCulloch written designed and all others having
or pretending to have interest in the said matter to
Compear before the Commpany of Kirkcubright or has depute
day & place within written peremplarly in the hour of cause
& answer at the Instance of the within desig[nat]ed Elizabeth
& Jamie McCulloch in said matter to the Effect and for
the reasons & causes within expressed. This I did and made
Certification Conform to the said written Edict whereof I
affixed a written a [written?] Copy Subscribed by me upon
the said Marcat Cross before these witnesses as William Fouler
& John Meal whom both in Kirkcudbright James Fouler

hundred and fifty six years. I James Fouler Commissary officer
part at Command of the within written Edict to the most patent door
of the church of Anwoth & thereat being a Sabbath day immediately
after drums sound and the blessing was said in the fornoon
I duly read & published this said written Edict & by virtue upon
in Name & authority within contained lawfully Summoned warned &
charged all & Sundry the Execs. Testamentary Spouse Bairns if any be
and Intromettors which the Goods and Gear of the Decease Edward Mc
Culloch within design[nate]d and all others having or pretending to have
Interest in said Matter to Compear before the Commissary of Kirkcud
bright or his Deputies day & place within written peremparly in this
hour of cause to answer at the Instance of the within design[ated] Eliz.
& James McCulloch in this matter to this Effect & for the reasons and
Causes within Expressd. This I did & made Certification Conform to
the Law Edict before these witnesses Hugh Anderson Inde[?] warden[?] at
Kircudbright & John McCoshne at Clauchan of Anwoth hereto
